These Terms & Conditions ("Terms") govern your access to and use of the Eklavya platform ("Platform"), operated by CMB Greens LLP ("we", "our", "us").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Eligibility and Account Registration

• You must provide accurate, complete, and current information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to notify us immediately of any unauthorized use of your account.
• Coaching institutes are responsible for the accounts created for their staff and students.

2. Use of the Platform

You agree to use the Platform only for lawful and legitimate purposes, including but not limited to:

• Creating, conducting, or attempting online tests
• Academic assessment and evaluation
• Educational and institutional use

You agree not to:

• Misuse or interfere with the Platform's functionality
• Attempt unauthorized access to systems or data
• Upload malicious code, viruses, or harmful content
• Engage in cheating, impersonation, or fraudulent activity
• Use the Platform for any illegal or prohibited purpose

3. Role of Coaching Institutes

• Coaching institutes using the Platform act as the primary administrators and controllers of student data.
• Institutes are responsible for:
  • Obtaining necessary permissions and parental consent (where applicable)
  • Ensuring appropriate use of the Platform by students
  • Managing tests, content, and access permissions

CMB Greens LLP is not responsible for internal policies or actions of coaching institutes.

4. Student Use

• Students may access the Platform only through authorized credentials provided by their institute.
• Test results, performance data, and responses are generated automatically and may be shared with the respective institute.
• The Platform does not guarantee academic outcomes or performance improvements.

5. Intellectual Property

• All content, software, design, logos, and trademarks on the Platform are the property of CMB Greens LLP or its licensors.
• Coaching institutes retain ownership of the test content they create.
• Users may not copy, modify, distribute, or reverse-engineer any part of the Platform without prior written permission.

6. Platform Availability

• We strive to keep the Platform available and functional but do not guarantee uninterrupted or error-free operation.
• Maintenance, updates, or technical issues may result in temporary downtime.
• We are not liable for any loss resulting from service interruptions.

7. Data and Privacy

• Use of the Platform is subject to our Privacy Policy, which forms an integral part of these Terms.
• By using the Platform, you consent to the collection and use of data as described in the Privacy Policy.

8. Termination and Suspension

We reserve the right to:

• Suspend or terminate access to the Platform without prior notice if:
  • These Terms are violated
  • The Platform is misused
  • Required by law or security concerns

Upon termination, access to accounts and data may be restricted or deleted, subject to legal requirements.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided on an "as is" and "as available" basis.
• We do not guarantee accuracy, reliability, or suitability of test results.
• CMB Greens LLP shall not be liable for:
  • Loss of data
  • Academic or business decisions based on Platform outputs
  • Indirect, incidental, or consequential damages

10. Indemnification

You agree to indemnify and hold harmless CMB Greens LLP from any claims, losses, damages, or liabilities arising from:

• Your use of the Platform
• Violation of these Terms
• Violation of applicable laws or third-party rights

11. Third-Party Services

The Platform may integrate or link to third-party services. We are not responsible for their content, availability, or practices.

12. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted on the Platform with a revised "Last updated" date. Continued use of the Platform constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.
